FOCO: Family Budget — Terms of Use

These Terms of Use ("Terms") are an agreement between you and VLR Software LLC ("VLR Software," "we," "us," or "our") governing your use of FOCO: Family Budget ("FOCO" or the "App"). By downloading or using FOCO, you agree to these Terms. If you do not agree, do not use the App.

The App is also licensed under Apple's Standard Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA. If these Terms conflict with the Standard EULA, the Standard EULA controls to the extent required by Apple or applicable law.

1. Eligibility

You must be legally capable of agreeing to these Terms. If you are a minor, you may use FOCO only with the permission and supervision of a parent or legal guardian where required by law. You are responsible for complying with the laws that apply where you use the App.

2. What FOCO provides

FOCO is a manual budgeting, bookkeeping, planning, sharing, and reconciliation tool. It helps you organize information that you and your invited participants enter. FOCO does not connect to a bank, verify a bank balance, initiate payments, transfer money, hold funds, provide credit, or act as a financial institution.

FOCO's displayed balance, remaining amounts, safe-to-spend figures, reports, reconciliation score, budget health, and similar results are estimates based on the records and settings available to the App. They may be incomplete or inaccurate if transactions are missing, duplicated, delayed, categorized incorrectly, recorded in a different currency, or entered incorrectly.

3. No financial, tax, legal, or investment advice

FOCO is provided for personal organization and informational purposes. It does not provide financial, accounting, tax, legal, investment, credit, or banking advice. Nothing in FOCO is a recommendation to spend, save, invest, borrow, or take any financial action. You remain responsible for verifying information against your bank and other authoritative records and for obtaining advice from a qualified professional when appropriate.

4. Your records and responsibilities

You are responsible for:

the accuracy, completeness, legality, and appropriateness of information you enter;
reviewing drafts, receipt recognition, suggestions, calculations, and recurring-payment confirmations before saving or acting;
reconciling FOCO with your actual financial accounts;
protecting your device, Apple Account, passcode, shared-budget invitations, and exported files; and
maintaining any independent records or backups you need.

Do not enter bank passwords, payment-card security codes, government identification numbers, or other unnecessary sensitive credentials into FOCO notes or support messages.

5. Shared budgets

Budget owners choose whom to invite and what access to grant through Apple's sharing controls. Invited participants may view or edit shared information according to their access. Changes by one participant may synchronize to others, and deletion or editing may affect the shared record.

You must have permission to share any information you place in a shared budget. You may not use sharing to harass, deceive, surveil, exploit, or violate the privacy or rights of another person. VLR Software does not mediate household disputes and is not responsible for actions taken by other participants. Owners should revoke access when it is no longer appropriate.

6. Apple Intelligence and automated suggestions

FOCO may use on-device Apple Intelligence to interpret requests, prepare drafts, explain deterministic results, or rank possible explanations based on records already in the App. Artificial-intelligence output can be incomplete or incorrect.

AI suggestions are not financial advice or proof that a transaction occurred. FOCO is designed to require user review and confirmation before adding or changing financial records. You are solely responsible for deciding whether to accept a suggestion.

7. Premium purchases and subscriptions

FOCO may offer monthly and annual auto-renewing subscriptions and a lifetime, non-consumable Premium purchase through Apple's in-app purchase system. The products and prices available to you are those displayed by Apple in the App at the time of purchase.

Payment is charged to your Apple Account when you confirm the purchase.
An auto-renewing subscription continues for successive periods unless you cancel it through your Apple Account at least 24 hours before the end of the current subscription period, subject to Apple's terms and regional rules.
Apple handles billing, renewal, cancellation, purchase approval, and refunds. VLR Software does not receive your full payment details and cannot directly issue App Store refunds.
You can manage subscriptions through your Apple Account and use Restore Purchases in FOCO when appropriate.
A lifetime purchase means access to the Premium features offered under that product for the supported life of the App; it does not transfer ownership of the App or guarantee that every future feature, service, or platform will be included forever.

Premium availability may depend on App Store services and successful entitlement verification. Except where required by law or Apple's policies, fees are non-refundable.

8. Privacy

Our handling of information is described in the FOCO Privacy Policy, which is incorporated into these Terms. Your use of Apple services such as iCloud, StoreKit, Siri, and App Store purchases is also subject to Apple's terms and privacy practices.

9. License and intellectual property

Subject to these Terms and the Standard EULA, VLR Software grants you a limited, personal, non-exclusive, non-transferable, revocable license to use FOCO on Apple-branded products you own or control as permitted by the App Store Usage Rules.

FOCO, including its software, design, name, graphics, and original content, is owned by VLR Software or its licensors and is protected by applicable intellectual-property laws. Except where applicable law expressly permits otherwise, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, defeat security controls, or attempt to derive source code from the App.

You retain rights in information you enter. You grant only the limited rights necessary for the App and Apple's services to store, synchronize, display, export, and share that information according to the features and choices you use.

10. Acceptable use

You may not use FOCO to violate law, infringe another person's rights, distribute malware, interfere with the App or Apple services, gain unauthorized access, misrepresent financial activity, or facilitate fraud or abuse.

11. Availability, changes, and termination

We may update, add, modify, suspend, or discontinue features to improve FOCO, respond to security or legal requirements, or reflect changes in Apple platforms and services. Some features require iCloud, Apple Intelligence, StoreKit, compatible hardware, network access, or a supported version of Apple's operating systems and may not be available at all times or in every region or language.

You may stop using FOCO at any time. We may terminate the license if you materially violate these Terms. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.

12. Third-party and Apple services

FOCO relies on services and frameworks provided by Apple. VLR Software does not control and is not responsible for the availability, security, terms, or operation of Apple services. Links or export destinations outside FOCO are provided for convenience, and your use of them is governed by their own terms.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOCO IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT FOCO'S RECORDS, ESTIMATES, SUGGESTIONS, RECOGNIZED RECEIPT TEXT, AI OUTPUT, SYNCHRONIZATION, SHARING, OR RECONCILIATION RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR NON-WAIVABLE CONSUMER RIGHTS REMAIN UNAFFECTED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VLR SOFTWARE AND ITS MEMBERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, SAVINGS, GOODWILL, OR OPPORTUNITY; MISSED OR DUPLICATED TRANSACTIONS; OVERSPENDING; TAX OR ACCOUNTING CONSEQUENCES; OR LOSSES ARISING FROM RELIANCE ON FOCO, APPLE SERVICES, AI OUTPUT, SHARED-BUDGET ACTIVITY, OR EXPORTED DATA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VLR SOFTWARE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO FOCO WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR FOCO DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$10. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold VLR Software harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of FOCO, information you share without authorization, infringement of another person's rights, or material violation of these Terms.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles, except that mandatory consumer protections in your place of residence continue to apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17. Apple

These Terms are between you and VLR Software, not Apple. Apple has no obligation to furnish maintenance or support for FOCO beyond any obligations imposed by applicable law. To the extent permitted by law, Apple has no warranty obligation for FOCO. Apple is not responsible for addressing claims relating to FOCO or your possession and use of it, including product-liability, legal-compliance, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.

18. Changes to these Terms

We may revise these Terms. The updated version will be posted at this URL with a revised effective date. If a change is material, we will provide additional notice when reasonably appropriate. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.
